Terms and Conditions
All wines are sold in California and title passes to buyer in California. We make no representation as to the legal right of anyone to ship or import wines into any state outside of California. By placing an order with us, you authorize us to act on your behalf to engage a common carrier to deliver your order to you.
At this time we ship to the following states: CA, CO, CT, FL, D.C., MN, NY, TX, VA.
Wines purchased are subject to local sales tax.
If you have an account with a wine forwarding company that ships to your state, please enter their address as your ship to address and they will contact you regarding shipments. Contact us for alternate shippers if you are interested. 707-251-0173, info@davianawinery.com For California based alternate shippers, California sales tax applies.

Customer Service Policy and Procedures
Shipping Policy
Daviana Winery complies with all federal, state and local laws regarding sale of alcohol.
You must be 21 years or older to purchase wine. When you order wine you are stating under penalty of perjury that you are 21 years or older.
An adult signature is required to receive the wine upon delivery. If adult is not available to accept wine, additional attempts will be made, if unsuccessful the wine will be returned to the distribution center.
Your credit card is charged at the time of purchase. All sales are final.
Wine orders received on a Friday will ship out the following Monday. In the hotter months, we reserve the right to either delay shipping and or highly suggest you ship overnight for quality assurance. Wines ship weather permitting. Returns, Refunds, Exchanges
Your satisfaction is our number one concern at Daviana Winery. To return and/or exchange wine please comply with the following:
-Please contact us at (707) 251-0173 or info@davianawinery.com so we can discuss your return/exchange with you prior to any returns being made.
-On your receipt please circle the item being returned, and note the date, time and person you spoke with regarding your return and/or exchange approval.
-State reason for return on the receipt.
-In the case of cork taint or leakage, please include the cork from the affected bottle.
-Let us know where to ship exchanged item if different than the original shipping address.
-Pack and seal your return along with the order receipt and information requested above.
Note: We do not offer refunds. We will exchange wine for same varietal vintages only. Shipping and handling charges are non-refundable.
Limitation of Liability
Daviana Winery shall not be liable for any delay in performing any of its obligations. It shall not be liable for any indirect, incidental or consequential damages without limitation arising out of the use of the website.
